Terms of Use

Welcome to The Inn ("The Inn Co.," doing business as "The Inn," "we," "us," or "our"). The Inn is a private, invite-only community for creators. These Terms of Use ("Terms") govern your access to and use of The Inn. By joining, accessing, or using The Inn, you agree to be bound by these Terms. If you do not agree, you may not access or use The Inn.

1. Eligibility & Membership

  • Invite & Application: Access to The Inn is by invitation only. Invitations do not guarantee membership. All invitees must apply, and membership is granted at our sole discretion.
  • Subscription Fees: Membership requires a monthly subscription fee. Payments, cancellations, and renewals are managed through your account. Fees are non-refundable except where required by law.
  • Non-Transferable: Membership is personal to you. You may not sell, transfer, or share access.
  • Age Requirement: The Inn is only available to individuals 18 years or older. By applying or joining, you represent that you meet this requirement. If you misrepresent your age or eligibility, you assume all resulting liability, and we disclaim responsibility for any resulting use or harm.
  • Revocation: We reserve the right to revoke or suspend membership at any time, including for failure to pay fees, violations of these Terms, or conduct we determine harmful to the community.

2. Community Guidelines

  • Respect & Conduct: Members must treat each other with professionalism, respect, and integrity. Harassment, hate speech, exploitation, or unlawful activity is strictly prohibited.
  • Confidentiality: Privacy is central to The Inn. Members may not screenshot, record, share, or disclose content, discussions, or member identities outside of the community without explicit consent.
  • Content Sharing: You may use features designed to support collaboration and recommendations. However, direct advertising, solicitation, or promotions may be restricted if they conflict with community guidelines.
  • Enforcement: Violations of these guidelines may result in immediate suspension or termination of membership, without refund.

3. Content & Intellectual Property

  • Your Content: You retain ownership of content you share. By posting, you grant us a limited, non-exclusive, revocable license to display and distribute your content within The Inn for community purposes only.
  • Our Content: All trademarks, branding, designs, and materials related to The Inn are our intellectual property and may not be copied, modified, or used without our written consent.
  • Takedown Requests: If you believe your rights have been infringed, please contact us atcontact@theinn.io.

4. Privacy & Data

  • Data Collection: We collect basic account information and analytics to maintain platform functionality.
  • Third-Party Connections: You may connect Instagram and other social accounts to enable community features and insights. These connections are encrypted and secured.
  • No Automatic Actions: We will never post, act, or share on your behalf without your explicit consent.
  • No Third-Party Sharing: We will never sell or share your personal data with third parties. We may use anonymized or aggregated data to improve features and provide insights.

5. Assumption of Risk & Liability

  • Member Responsibility: You assume all risks related to your interactions, collaborations, and activities with other members.
  • Limitation of Liability: To the fullest extent permitted by law, The Inn is not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid for membership in the twelve months preceding the claim.
  • Indemnification: You agree to indemnify and hold harmless The Inn, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the community or your conduct.

6. Termination & Suspension

We may suspend, limit, or terminate your membership at our discretion for any violation of these Terms, non-payment, or actions inconsistent with the spirit of the community.

7. Dispute Resolution

All disputes arising out of or relating to these Terms or The Inn shall be resolved exclusively by bindingarbitration in California, under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in class actions.

8. Modifications

We may update these Terms from time to time. The "Last Updated" date will reflect changes. It is your responsibility to review the Terms periodically. Continued use of The Inn after updates constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws, except that arbitration will take place in California as provided above.
